Terms Of Service

These Terms of Service govern your use of GolfTap and the services we provide. Please read them carefully.

1. Agreement to Terms

By accessing or using GolfTap ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

GolfTap is operated by GolfTap Limited, a company registered in Ireland. These Terms constitute a legally binding agreement between you and GolfTap Limited.

2. Description of Service

GolfTap provides a cloud-based golf club management platform that enables golf clubs to:

  • Manage tee time bookings and scheduling
  • Process payments through Square integration
  • Manage memberships and member accounts
  • Organize competitions and tournaments
  • Generate reports and analytics
  • Provide public booking portals for guests
  • Manage golf course operations and settings

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

You may not use another person's account without permission. We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Types and Responsibilities

GolfTap supports different user types with different levels of access:

  • Golf Club Administrators: Full access to manage golf club account, courses, staff, and settings
  • Golf Club Staff: Access to manage bookings, check-ins, and day-to-day operations
  • Members: Access to book tee times, view their bookings and memberships
  • Guests: Limited access to book tee times at public portals

Each user type must use the Service only for its intended purpose and in accordance with these Terms.

5. Subscriptions and Billing

GolfTap operates on a subscription basis with the following terms:

  • Subscription Plans: We offer Starter, Professional, and Enterprise plans with monthly or annual billing options
  • Pricing: All prices are stated in Euros (€) and exclude VAT unless otherwise stated
  • Payment: Subscription fees are billed in advance on a monthly or annual basis
  • Auto-Renewal: Subscriptions automatically renew unless cancelled before the renewal date
  • Booking Fees: Transaction fees apply to bookings processed through GolfTap (rates vary by plan)
  • Setup Fees: One-time setup fees apply to new accounts (non-refundable)

We reserve the right to change our pricing with 30 days' notice. Price changes will not affect your current billing period.

6. Payment Processing

GolfTap integrates with Square for payment processing. By using payment features, you agree to:

  • Connect a valid Square account for payment processing
  • Comply with Square's Terms of Service and acceptable use policies
  • Accept responsibility for all transactions processed through your account
  • Pay Square's standard processing fees (separate from GolfTap fees)

GolfTap is not responsible for payment processing failures, disputes, or chargebacks. All payment processing issues should be directed to Square.

7. Data Ownership and Usage

Your Data: You retain all rights to the data you input into GolfTap, including:

  • Member information and contact details
  • Booking and transaction records
  • Golf course configurations and settings
  • Competition and event data

You grant GolfTap a license to use, store, and process your data solely to provide the Service. We will not sell or share your data with third parties except as required to provide the Service or as required by law.

Data Protection: We comply with the General Data Protection Regulation (GDPR) and Irish data protection laws. See our Privacy Policy for details on how we handle personal data.

8. Acceptable Use

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Infringe on intellectual property rights
  • Transmit viruses, malware, or harmful code
  • Attempt to gain unauthorized access to the Service or other accounts
  • Interfere with or disrupt the Service or servers
  • Use automated systems to access the Service without permission
  • Impersonate another person or entity
  • Collect or harvest user data without consent

9. Intellectual Property

The Service and its original content, features, and functionality are owned by GolfTap Limited and are protected by international copyright, trademark, and other intellectual property laws.

Our trademarks and trade dress may not be used without our prior written permission.

10. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. The Service may be unavailable due to:

  • Scheduled maintenance (with advance notice when possible)
  • Emergency maintenance or repairs
  • Third-party service outages (including Square, hosting providers)
  • Events beyond our reasonable control

We are not liable for any losses resulting from service interruptions.

11. Limitation of Liability

To the maximum extent permitted by Irish and EU law:

  • GolfTap is provided "as is" without warranties of any kind
  • We do not guarantee that the Service will be error-free or uninterrupted
  • We are not liable for indirect, incidental, special, or consequential damages
  • Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

12. Indemnification

You agree to indemnify and hold harmless GolfTap Limited, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of any applicable laws or regulations

13. Termination

Your Rights: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial billing periods.

Our Rights: We may suspend or terminate your account immediately if:

  • You violate these Terms
  • You fail to pay subscription fees
  • Your use of the Service poses security or legal risks
  • Required by law or court order

Data Retention: After termination, we will retain your data for 30 days to allow for data export. After this period, your data will be permanently deleted unless required by law to retain it.

14. Modifications to Service and Terms

We reserve the right to modify or discontinue the Service (or any part thereof) with reasonable notice.

We may revise these Terms from time to time. Material changes will be notified via email or through the Service at least 30 days before taking effect. Your continued use after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Ireland.

If you are a consumer in the European Union, you may also have the right to bring proceedings in the courts of your country of residence.

16. European Union Users

If you are a consumer located in the European Union, you have certain rights under EU law including:

  • Right of Withdrawal: 14-day cooling-off period for new subscriptions (not applicable if you begin using the Service during this period)
  • Unfair Terms: Any term deemed unfair under EU consumer protection law will not apply to you
  • Warranty Rights: Nothing in these Terms affects your statutory warranty rights

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GolfTap Limited regarding the Service and supersede all prior agreements and understandings.
